1. Agreement

These Terms & Conditions form a binding contract between you (the "Subscriber") and ROCO Group Australia Pty Ltd trading as Just Send It AI. By creating an account, subscribing to a plan, accessing justsendit.com.au, or using the Platform, you agree to these Terms in full. If you do not agree, do not use the Platform. These Terms must be read together with our Privacy Policy, which is incorporated by reference.

2. Eligibility

  • Be at least 18 years of age;
  • Be a licensed or otherwise qualified tradesperson, or authorised to act on behalf of one;
  • Provide accurate, current, and complete information during registration;
  • Maintain the security of your account credentials.

You are responsible for all activity that occurs under your account. Notify us immediately at admin@justsendit.com.au of any unauthorised access.

3. Nature of the Platform — Indicative Quotes Only

3.1 What the Platform is

Just Send It AI is a software tool that uses artificial intelligence to generate indicative quote content based on inputs provided by you.

3.2 What the Platform is NOT

  • A licensed electrical contractor, plumber, builder, or trade service provider;
  • A provider of professional, legal, electrical, engineering, or safety advice;
  • A certifier of compliance with AS/NZS 3000, the Electricity (Consumer Safety) Act 2004 (NSW), the Home Building Act 1989 (NSW), or any other standard or law;
  • A substitute for a qualified, licensed tradesperson's on-site assessment, design, or workmanship;
  • A guarantee of pricing accuracy, scope completeness, or job profitability.

3.3 Indicative-only output

All quotes, pricing tiers, risk flags, compliance notes, scope of works, and any other output generated by the Platform are AI-generated, may contain errors or omissions, are indicative only, and must be verified by a qualified, licensed tradesperson before being relied upon or sent.

3.4 Your responsibility

  • You are the licensed professional responsible for every quote you send;
  • You will review and verify every AI output before sending it to any third party;
  • You will not represent that the Platform itself has certified, designed, or guaranteed any work;
  • You remain solely responsible for compliance with all applicable laws, standards, and licensing — including CCEWs under the NSW Building Commission ECERT regime;
  • You release JSI from any liability arising from your reliance on AI-generated content.

4. Account & Subscription

4.1 Plans and pricing

Plan tiers may include Founders, Starter, Pro, and Business. Inclusions and pricing may change. Any change will be notified in advance and will not affect your current billing cycle.

4.2 Founders Rate

If you subscribe on the Founders plan during the designated beta window, your monthly rate is locked for the life of your active subscription, subject to these Terms. If you cancel and later resubscribe, the Founders Rate is forfeited and standard pricing applies.

4.3 Billing

  • Billed monthly in advance via Stripe;
  • Prices in AUD, inclusive of GST unless otherwise stated;
  • You authorise us to charge your payment method on each renewal date;
  • Failed payments may result in suspension until rectified.

4.4 Cancellation

You may cancel anytime from your dashboard. Cancellation takes effect at the end of the current billing cycle. No refunds for partial months unless required by law.

4.5 Refunds

Consistent with the Australian Consumer Law (ACL), you are entitled to a refund where the Platform fails to meet a consumer guarantee. We do not offer refunds for change of mind, non-use, or dissatisfaction outside ACL rights.

5. Acceptable Use

You agree NOT to:

  • Use the Platform for any unlawful, fraudulent, or deceptive purpose;
  • Generate quotes for trades or jurisdictions you are not licensed for;
  • Submit content you do not have the right to use;
  • Reverse engineer, decompile, scrape, or extract source code, AI prompts, or models;
  • Resell, sublicense, or white-label the Platform without our written consent;
  • Use the Platform to train or develop a competing AI product;
  • Upload viruses, malware, or harmful code;
  • Attempt to gain unauthorised access to any account, system, or data;
  • Misrepresent your licence status, credentials, or qualifications;
  • Use bots or scrapers without express written permission.

Breach may result in immediate suspension or termination without refund.

6. Intellectual Property

6.1 Our IP

All IP in the Platform — including the Just Send It AI name, logo (Trinity Send Mark), software, AI system prompts, designs, and content — is owned by or licensed to ROCO Group Australia Pty Ltd. Trade mark "JUST SEND IT AI" is registered with IP Australia (TM #2640661, Classes 35 & 42). You receive only a limited, non-exclusive, non-transferable, revocable licence to use the Platform during the term of your subscription.

6.2 Your content

You retain ownership of content you upload. You grant us a worldwide, royalty-free, non-exclusive licence to host, process, transmit, display, and use Your Content for the purpose of operating and improving the Platform, including transmission to AI sub-processors as described in our Privacy Policy.

6.3 De-identified usage data

We may use aggregated, de-identified data to improve our service, train internal models, develop features, and produce industry insights. This data is not attributable to you.

6.4 Feedback

If you provide feedback, you assign to us all rights in that feedback and we may use it without obligation or compensation to you.

7. Third-Party Services

The Platform integrates with third-party services (e.g. Stripe, Supabase, Anthropic, GoHighLevel, n8n, and future integrations such as Xero, QuickBooks, MYOB, and the Building Commission NSW ECERT API). Your use is subject to their own terms and privacy policies. We are not responsible for their acts or omissions.

8. Availability & Changes

8.1 No guaranteed uptime

We make commercially reasonable efforts to keep the Platform available but do not guarantee uninterrupted access.

8.2 Beta features

Features marked "beta", "experimental", or "preview" are provided as-is and may be modified or discontinued without notice.

8.3 Changes to the Platform

We may modify, add, or remove features at any time. We will provide reasonable notice of changes that materially reduce functionality.

9. Disclaimers

To the maximum extent permitted by law, the Platform is provided "as is" and "as available", without warranties of any kind, except as required by the ACL. We do not warrant the Platform will be error-free, secure, or that AI outputs will be accurate, complete, or fit for any particular purpose. Nothing in these Terms excludes any consumer guarantee under the ACL that cannot lawfully be excluded.

10. Limitation of Liability

10.1 Exclusion of indirect losses

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages; loss of profit, revenue, business opportunity, goodwill or anticipated savings; loss or corruption of data; loss from client disputes, underquoted jobs, lost tenders, missed deadlines, regulatory penalties or compliance breaches; or loss arising from reliance on AI-generated content.

10.2 Liability cap

Our total aggregate liability to you for all claims is capped at the total fees paid by you to us in the 6 months immediately preceding the claim, or AUD $500, whichever is greater.

10.3 Australian Consumer Law

Where the ACL applies and a consumer guarantee is breached, our liability is, at our option, limited to re-supplying the relevant services or refunding the fees paid.

11. Indemnity

You agree to indemnify, defend and hold harmless ROCO Group Australia Pty Ltd, its directors, officers, employees, contractors and affiliates from any claims, damages, losses, liabilities, costs and expenses (including legal fees on a solicitor-client basis) arising out of or relating to your use of the Platform; any quote, work or service you provide to a third party; your breach of these Terms or any law; your infringement of any third party's rights; Personal Information uploaded about clients without proper consent; and your failure to comply with electrical, building or trade compliance obligations.

12. Termination

12.1 Termination by you

You may cancel as described in Section 4.4.

12.2 Termination by us

We may suspend or terminate your account immediately, without notice or refund, if you breach these Terms, fail to pay fees, are reasonably suspected of fraud or misuse, or where required by law.

12.3 Effect of termination

Your right to access the Platform ceases. We may delete your account and Your Content after a reasonable retention period (see Privacy Policy). Sections that by their nature should survive termination will continue to apply.

13. Governing Law & Dispute Resolution

13.1 Governing law

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of NSW and the Commonwealth of Australia.

13.2 Good-faith negotiation

Before commencing legal proceedings (other than for urgent injunctive relief), the parties will attempt to resolve any dispute in good faith via written notice to admin@justsendit.com.au, a 30-day negotiation period, and mediation through the Resolution Institute or similar Australian provider if negotiation fails.

14. General

  • Assignment — you may not assign without our consent; we may assign in connection with a sale, merger, restructure, or incorporation as Just Send It AI Pty Ltd.
  • Entire agreement — these Terms and the Privacy Policy are the entire agreement.
  • Variation — we may amend on reasonable notice; continued use is acceptance.
  • Severability — unenforceable provisions are severed; the rest continues in force.
  • Waiver — failure or delay to enforce a right is not a waiver.
  • Force majeure — we are not liable for events beyond our reasonable control.
  • Notices — to us at admin@justsendit.com.au; to you at your registered email.
